Occupational accident coverage for truckers & other commercial drivers (not required by law to be covered by workers’ compensation) is provided via membership in the United Truckers Association. Several different plans are available as follows:

For Groups of 1-25 Drivers (over 25 drivers see below under Large Groups)

W-2 Employee Driver plan where permitted§

Plans not available in the following states: North Carolina, New York, and Oregon. Restrictions apply in the following states: Colorado, Maryland, Minnesota, North Dakota, Rhode Island and Vermont. Call for details. Contingent Liability not available in the state of Delaware.

NOTICE:
§Occupational Accident Coverage is available to W-2 employee drivers where the fleet owner/employer is not required by state law to provide workers’ compensation for his/her employees. Available in the following states: Alabama, Florida, Georgia, Mississippi, Missouri, New Mexico, South Carolina, Tennessee, Texas, and Virginia.

LARGE GROUPS
(Over 25 Drivers)

For Comparison Rate Indication, the following is needed:
  1. Completed motor carrier application.
  2. Copy of present policy, 3 years loss runs and renewal cost.
  3. Copy of lease agreement

Contingent Liability Overview:
Protection for the Motor Carrier
(available for groups of 10 or more drivers)

Our program offers the trucking industry a unique approach to Occupational Accident Coverage by providing the Motor Carrier with the backup protection of a Contingent Liability policy while retaining the savings of occupational accident insurance.

The contingent program works as follows: Insuring Agreement. Upon the occurrence of a Covered Contingency, the insurance company will, at their sole option and in accordance with applicable law, either:

  1. Pay benefits that are equivalent to the benefits payable under the workers’ compensation and employers’ liability law that would apply to the Named Insured if this Policy was a policy of workers’ compensation insurance, but only with respect to an Owner-Operator or Contract Driver who is deemed in accordance with applicable law to be an employee of the Named Insured by order of any administrative or regulatory agency or court of competent jurisdiction; or
  2. Same as above – but seeking to be deemed an employee of the Named Insured in accourdance with applicable law.

This Policy provides for our right and duty to defend the Named Insured with respect to those benefits required under the workers’ compensation laws of such states, or such other states as may be determined to apply to the Owner-Operator, and/or Contract Driver.

NON-TRUCKING OCCUPATIONAL ACCIDENT PLANS are also available

This again is for self-employed people or others not required by law to be covered by workers’ compensation.
